Default Changing my son's last name

Hi I am from Louisiana. My son's father and I were married, so when my son was born of course he had his fathers last name. When my son was 10 months old his father kicked us out of our home and we have yet to see him since. My son will be 4 on September 20. When I went through my divorce I used a local legal aide office and they only did the divorce, I went back to my maiden name, but they could not change my son's last name. I have total and complete custody and recieve no child support. I have heard from mutual friends that he is willing to sign anything I needed so my son could have my last name I just don't know where to begin. PLEASE HELP!

You are probably able to petition the court which issued the child custody order to change your child's surname, upon your demonstrating that the name change is in your child's best interest.
