    Default What Rights Do I Have As a 17 Year Old in Michigan to Get Emancipated

    My question involves juvenile law in the State of: Michigan.
    hi i was just wondering what my rights are the house where i live is not a good environment for me to live in im 17 and the reason i want out of my house is my 15 year old brother is beating on my and there is 4 different accounts of domestic violence and assault on me going to he prosecutor and im tired if getting beat up and having to watch my back every time turn around im afraid hes gonna be there and i cant do it anymore my mom said i had to come home right before school started back up and i told her that i didnt want to, my brother sees a therapist but i doesnt seem to be working.

    i just need to know what i have to do to get emaciated i have talk to people and i have a place i can live, i have a job starting at the end of july first part of august and will make 7.40 but my birthday is next march what do i have to do to not have to go back?

    Short answer - you don't. Emancipation is not a right. It is a privilege, and one that very, very few teens will earn.

    but would the judge see what i mean by i dont want to go home? mind you those 4 times he beat me up were in 5 weeks

    Emancipation isn't a solution to abuse. Emancipation is a legal recognition of an already established situation of self support. You are not self supporting, so your petition would be denied, no matter WHAT other circumstances were occurring. If there is abuse occurring, there is one and ONLY one way to deal with it: intervention by police and/or child protective services. If you're getting beaten up, you need to be using 911 during or as soon after the incident as possible. Since there are already apparantly in-process cases going in involving your brother, and you apparantly still have fear of additional incidents occurring, what has social services said when you asked them about removing him from the home?

    If your parent/guardian allows you to live elsewhere, then you can certainly do so. If they won't, then you can ask child protective services to remove YOU from the home (understanding that THEY will then get to decide where you live then).
