    Question Changing Rent After Deposit Paid, Lease Signed

    My question involves landlord-tenant law in the State of: Kentucky

    Two roommates and I are moving into a townhouse that was advertised at $999 a month. After much looking we decided upon this place, paid our $500 deposit and two of us had signed the lease when the real estate agent informed us that the rent on the lease and all the information we had been given was incorrect and the monthly price was actually $1039, essentially a $40 increase. We asked if they would honor the price on the lease and what they had advertised it as and they said no giving us the options of moving ahead with the new price on a new lease or getting our deposit back.

    Thus my question: Do my roommates and I have any right to demand they keep the price outlined in the initial lease or are we stuck paying the revised price?

    if the lease was already signed specifying the $999/mo cost, barring some clause within the lease allowing them to rescind or alter it, they are bound by the lease just as you are.

    have you signed an actual lease and complied with any requirements stated?

    Two out of the three of us had actually signed the lease before she notified us that the price would have to be changed. I was actually on my way to the leasing office to sign it as well when I was notified that it would have to be changed and thus I haven't signed it yet.

    We are going to look at the lease again today and I doubt there is any clause allowing them to change it but the entire situation hinges on the question of if a lease signed by two of the three parties involved with the deposit having been already paid would have taken effect yet. Our Realtor also claimed that since her boss had not signed the lease, it was not valid yet.

    two out of three isn't three out of three. So, the next question would be: would the lease be enforceable by or on the two. No, it wouldn't.

    that wouldn't be an issue. In fact, many times the LL never signs the lease yet it is wholly enforceable.
