The man who has raised him his whole life is his parent even though their not related biologically. It matters not what you think is right or fair, or what you want.

What matters is that you picked him to father your child - you gave him those rights. He was not obliged to pay you a single cent in child support until/unless he was ordered to do so.

Once again, Dad will get visitation if he wants visitation. I just hope that your son knows that your current partner is not his father.

because he caused you to become pregnant. There is a difference between a good parent and simply a legal parent. While he many not be a good parent, he is the legal parent whether you like it or not.

And yes my child knows that the person helping me raise him is not his biological father and he tells me that he is scared that his dad is going to come and try to take him away. He doesn't even know him at all he just knows that he didn't care enough about him to stay here and might I add that his father is an illegall immigrant so I think that it will come out in my favor because of that and if he tries to come back I can just call immigration and get him deported. Over my dead body he will get any where near my son.. I just posted on here to get some advice about how I can get his name changed but I think that I'm getting attacked. If you're dead, Dad gets custody. His immigration status means NOTHING in family court. So - he was illegal when you slept together and you were fine with then, right? Does it occur to you that your son might be visiting Dad in MEXICO?

No, you're just not liking the legal reality. I can't help that. But if you seriously think you can forever erase him and prevent him from having contact with HIS child, you're in for a very nasty surprise.

#1 no one is filling his head with anything why? Because my parents did it to me when I was little and I hated it..he is 6 yrs old for god sake he knows by now who loves him and who doesn't..and its sure not his dad..
#2 no it didn't bother me then but if it comes down to it I can use it to my advantage
#3 I don't know where u live but I hope to god that the judges here in tennessee are smart enoughto know when its appropriate to give visitation rights to someone and when its not..

IF dad does come back, any visitation he would get would be limited and almost guaranteed to be supervised and remain in Tennessee. As the child becomes used to dad, the visitation would extended and eventually, unsupervised. Eventually, yes, the child could be allowed to go to Mexico to see dad if that is where dad lives.

so, how do you know dad doesn't love his son? Didn't you say he hasn't had contact? That doesn't mean he doesn't love his son. Hell, for all you know dad could be in jail or dead.
