    Angry Roommate Not on Lease and Not Paying Rent

    My question involves an eviction in the state of: My roommate has always had a problem with paying his utilities on time or even at all. They were explicitly stated in our verbal agreement, as that is all we have between us that he would pay half. Now he owes me nearly $900. I want to evict him but I also want my money.

    He is not on the lease, and I am curious as to if I can evict him myself? If so, can I just change the locks and leave his stuff on the front lawn? Also, since he isn't on the lease, and my landlord has a stipluation that he can live there but they can demand him out at a moments notice, can I use that if they will help me? If I change the locks, can I keep his $800 plasma TV inside as payment?

    I live in Arizona, any help would be appreciated.

    that's a really bad idea

    well, actually your landlord couldn't demand anything of the sort nor can you.


    to whom is your roommate liable to for rent? If you are the only signator on the lease, I would have to assume your roommate actually owes rent to you and you are liable to the landlord for whatever the lease states.

    wanting to meet Sheriff Arpaio? It is a crime to take other people's property.


    If you are liable to the LL for the entire rent, your roommate is technically your tenant. As such, you have to act like a landlord (no, I don't mean ignore all the requests to fix things and bang on your door at 3 in the morning when rent is 1 day late) but you must follow the legal eviction process.

    Follow jks advice. Caution, many state laws require all persons over 18 that live in a dwelling for over two weeks to be listed as a Rentor or occupant. You could be in violation.

    How long has your tenant lived in the house? You'll probably have to go through the normal eviction procedures. Begin the process by serving the appropriate notice.
