    Question What Happens When a H1B Employer Goes Bankrupt

    I work for company-A on H1B visa. The company filed for chapter 11 bankruptcy in March 2012. The bankruptcy court appointed a CRO for company-A who in June held bidding for company-A. In the bidding, a substantial portion (more than 80%) of company-A was sold to company-B under a 363-Sale (sale of assets i believe). The company-B wants me to work for them. My question is- will company-B have to TRANSFER my H1B or can they AMEND it?

    If they have to TRANSFER my H1b to their company, and want me to work starting 1st of July 2012, then should i tell them to go for premium processing or will the normal processing suffice?

    You will have to find out from Company B whether their acquisition of Company A is sufficient to carry over your visa, or if they must 'transfer' it. We have no way to investigate that for you.
