My question involves collection proceedings in the State of: California
My husband's employer received a phone call today from an attorney, wanting to confirm my husband was still employed with the company and the company address. The attorney stated he would be garnishing wages for credit card debt.
We haven't had a credit card in nearly 4 years. We have never been served with any lawsuit, judgment, or summons pertaining to any credit card debt.
Can the wages be garnished without us being served with a summons, judgment or lawsuit, or any kind of process regarding any debt?
Is this guy just "phishing" trying to get information, or get us to acknowledge a past debt?
I believe the credit card was paid off when we canceled. We have had no conversation, no correspondence with any debt collector regarding any past due credit card debt.
Please advise our best course of action.
