Default Can Unemployed Apply for a Tourist Visa

    Good day,

My mother wants to visit my sister, who's a permanent resident in the U.S. and married to a U.S. citizen. My sister is pregnant now and my mother wants to be by her side when she gives birth. But my mom got rejected once about 4-5 years ago, when she applied for a tourist visa. At that time she was divorced, I - her son - lived in a different country. Since then she got married again to my dad, and I returned to my home country. But she's still unemployed.

Could you advise, what steps should be taken to strengthen her application? I can provide her with about $10.000 on her bank account, if that plays any role. She wants to apply for a six months stay in the U.S.

Are there any chances that she'll get the visa, or previous rejection and current unemployment will ruin her application?

    Please, advise. Thank you!

Was that the reason she was denied the first time? Was it 212(a)(4)? Is her current husband employed? What country is she coming from?

I'm quite sure it was INA section 214(b). In the denial statement was written something like they didn't have enough reasons to believe that she's going to return home. Her current husband is employed. She is from Armenia.

She should apply for a shorter stay. She does need to show she can support herself during her stay. She should also show correspondence like birthday cards, etc., from current husband, along with marriage certificate and joint bank accounts, billing accounts, etc. They want to know she will be returning home after her stay, proof of the relationship with her husband....

So she should not apply for six months? What is the longest period she should apply for? And what is the minimum amount she should have on her bank account for six months stay? Thank you!
