My question involves unemployment benefits for the state of: California
Last year I was collecting unemployment benefits while working part time for 1-2 days/week. At the time, I was paid hourly along with commissions. I did my best to estimate my hourly commission earnings which were reported on my continued claim form and then deducted from my bi-weekly unemployment checks. Last month I received a "Notice of Overpayment" from the EDD showing the amounts that I reported and the amounts reported by my employer. The total amount I was overpaid was $630 which included a 30% penalty. I didn't dispute that I owed the money and immediately send payment in full to the EDD.
The issue now is that the company I work for is probably going out of business in a few weeks. On the "Notice of Overpayment" it said that I may be disqualified for future benefits for 5-23 weeks.
Do have any recourse in this if I need to file for unemployment benefits in the near future?
