    Exclamation Divorce and Property Division, Alien Spouse With I-751 Filed

    My question involves a marriage in the state of:Florida

    I regretfully married this woman that just used me & toyed with my feelings just to get into this country only to find out she was planning on leaving me once she gets her citizenship; well she just filed for her I-751 yesterday. Anyway house is my name & then hers. We been married since 8/09 now how does the property get split she is telling me she wont sell it & it was her money that bought it; its paid for in cash so no mortgage. Of course thats a total lie cause money came from my bank account to pay for the house. So now my question is where do I stand; we currently live in South Florida if that matters. We have no kids just the home listed in my name & then hers thats paid for. What is the law on this when it comes to our home what is the time period of being married /ratio as I hear it some say 50/50 some say if I notify INS they can deport her? I have proof of a sour relationship from the begining; so many childish emails arguing from her end about stupid stuff. She is threatening not to sign the papers to sell or get the divorce obviously will she get sent back to her country if I file while she is in the I-751 process & of course the home....Many thanks ahead of time. I regret ever giving this woman my heart & love. She just used me; and pretending to be a Christian too; she just learned all my weakness's and used them against me.

    In Florida, all property acquired during a marriage is considered to be marital property and, upon divorce, is subject to "equitable distribution". That does not automatically mean that the division will be 50:50; the question of what is equitable will depend on the facts. However, all else being equal, the division is likely to be equal.

    Pre-marital property (subject to certain conditions) would normally be treated as separate property, as would gifts and inheritances received after the parties enter into marriage.
