I am not sure if this should be posted under alcohol offenses or battery since it has to do with both. I live in Georgia and went out on my birthday back in June. I got extremely intoxicated and blacked out apparently got into a scuffle with a bouncer from a bar and the police intervened. I have no recollection of any of the events but according to the police report: after their intervention I began to scream and curse at them so they placed me under arrest and handcuffed me and put me in the back of the car. I was still raging in the back of the car so they opened the door and put shackles on me and apparently I kicked the officer who was placing the shackles on me, however, I do not believe it was intentional and its important to mention I was barefoot and he said during the bond hearing no injuries were recieved by any officer and no medical attention was needed. Apparently at some point rather intentional or not I spat on a police officer although again I have no recollection of doing this.
I was charged with Public Drunkeness, Disorderly Conduct, 2 Counts Simple Battery to Officer, and Felony Obstruction. I have no prior violent offenses and I am 28 years old. The only charge on my record is a federal drug charge in which I completed my 5 years supervisedprobation, fines, and community service without a problem. I am a senior in a local university graduating in May with a BA in psychology and I have held my current job for the last 6 years. My old probation officer is willing to write a letter stateing that I never caused any problems on probation and I have prefessors willing to write letters of character about my academic standings and such.
My questions are:
1) Can the Felony Obstruction charge hold up in court since obstruction means that you "knowingly" hendered officers ability to arrest you when I didnt "knowingly" do anything that night or will it most likely be reduced to something like resisting.
2) Even with the merits of school and letters as well as employment is there still a high risk of serving time or what are the chances of recieving extensive probation, anger management, alcohol treatment, etc...
3) What are the most important things to do to try not to recieve jail time for the offenses?
Any help would be greatly appreaciated this was a one time mistake not a regular occurance and while I know being drunk is not in anyway an excuse for the behaviors I would rather do whatever is possible to recieve help for the problems rather than punishment for the crimes.
P.S. In the three monthes since the offenses I have not had a single drink if that helps at all.
