    Default Emancipation Rights in Louisiana

    My question involves juvenile law in the State of: Louisiana

    My daughter is 16 years old and we are currently living in slidell Louisiana. We moved here from Colorado 2 years ago for work. I have finished what I was doing and mid next month we will return to Colorado. My daughter does not want to go, insists the she won't, and will get herself emancipated. I have read several of the forums and understand that she has to prove independence and all that. My question is: If she takes off before we are getting ready to move and I report her as a run away, does that status change if she is able to successfully file emancipation papers? Any better ideas than reporting her a run away?

    She can't file for emancipation, period. In Louisiana, the parents must file the emancipation petition. No parental consent means no emancipation.

    Any better ideas than reporting her a run away?
    Chain her to the desk. I'm only half joking. (I have a teenager of my own, and his 20 year-old brother was still a teenager a week ago.)

    And in any case, (1) "I don't want to move" is not grounds for emancipation in any state and (2) if she runs away, she's just kissed any hope of emancipation goodbye, even if you DID decide to consent. Emancipation, on those rare occasions that it is granted, is granted only to those teens who have shown exceptional maturity as well as proof of the ability to support herself. Parental consent does not guarantee judicial consent, and the judge is not going to be overly impressed with the maturity of a kid who runs away when she doesn't get her own way.
