My question involves labor and employment law for the state of: Virginia
I have a question regarding my recently deceased father's termination from his employer. I believe the circumstances for his termination were not justified and want to find out if there is grounds for a suit against the company. (an unnamed large fortune 100 pharmaceutical company)
Quick synopsis of what happened, my dad took medical leave from his company to pursue a mental health evaluation for which he was diagnosed with severe depression. Upon coming back from leave he was terminated due to "poor performance" even though he was cited as being a highly favored employee prior to his depression issues, which was documented with a performance report. After termination, he continued to suffer from depression and then was quickly also diagnosed with a very aggressive and deadly cancer which caused his passing recently. (this was all within a 3 year time span 2009-2012)
What I want to do is find out if there is ground for me to pursue a wrongful termination suit against his company, I feel like he was stripped of the benefits he worked so hard for during his 13 years with the company. And now because of their decision to terminate him while he was suffering from mental health issues, and then also cancer that my family is financially burdened from medical bills, loss of income and loss of his life insurance that would have been paid out from his benefit package.
