    Default Landlord Coming into My Yard Unannounced

    My question involves landlord-tenant law in the State of: California


    My landlord likes to come into my yard unannounced - and with no feasible reason.

    The yards between us are divided by a fence. The lock on the fence (which I cant reach) only allows for him to come into my yard - not for me to go out.

    It makes me really uncomfortable that he's just coming into my yard - unannounced with no real reason.

    I've caught him in the past and his excuse was that my yard was "messy". OK fine, I dont want you in my yard so now it's been clean for months on end.

    He's had "workers" in my yard without any notice repairing fences and things before as well - OK fine they are doing work - but being this is part of the unit I am paying for shouldnt I be notified?

    I've asked him for notice before and he tells me (he does construction) that he doesn't know because he sends his workers to the property to fix things when the construction site he works at is slow.

    The only real reason that he could be back there (from my point of view) is that there is a storage shed which he uses for firewood. And although not actually discussed per moving in (i just assumed it would be for my use since I'm renting the space) So occasionally he may need to be back there to grab some wood - however it's now summer time and there's absolutely no use for fire wood.

    I've told him that I'm uncomfortable with people in the yard unannounced.

    Upon moving the old tenant left a table out on the deck - which i didnt mind having around - but after I noticed the landlord freely coming into my yard unannounced I moved the table in front of the gate to help prevent him from coming into my side of the yard. One day I come home and the table is gone - he through it out and basically told me "i had no use for it". This is some 1 year+ I've been living here with the table in my yard.

    Ok whatever - Now I put potted plants in front of the gate so I know when he's back there - he was back there today - no fire wood was added - he's no having a fire in the fire place, no maintenance has been done - so I'm just at a loss as to why he is coming back there.

    The other day I came home from work and he was completely drunk (i could smell it on his breath) and trying to talk to me so I just rushed inside. A short while later I see him coming into my side of the yard - then not wanting to have a confrontation with a drunk - I let him do whatever he was doing and he leaves and leaves the gate open so his dog can come into my side of the yard (which his dog has gotten into my side of the yard and destroyed my property before)

    I know 24 notice is required to enter the premises - does the yard fall under the premises? is there any legal recourse? Do I have any options other than just moving?

    Any insight, thoughts and help are much appreciated
