    Default Wrongful Death Caused by Hit and Run

    My question involves an injury that occurred in the state of: Texas
    On aug.8,2011 my son was killed by a hit and run driver. How long do i have to file an ins. clam?

    While I don't know of any statutory limits on making insurance claims, you have two years from the date of his death to file a lawsuit over the matter.

    If you're talking about uninsured/underinsured motorist coverage, or some other policy that might provide coverage, as opposed to the hit-and-run driver's unknown insurance policy, you need to check the terms of the policy (or policies) at issue to determine what deadlines they impose for the submission of claims.

    Are you asking - "if the police find who is responsible for the hit and run 2 years from now, would it be to late to file a claim?" I would think you have 2 years from the date that the police find out who is responsible.
    I'm not a lawyer, but I did stay at a Holiday Inn Express last night.......

    In practice, the statute of limitations for filing of a civil suit is the cutoff for filing an insurance claim. Some additional facts on what happened would be good.

    The statute of limitations would restrict when you can sue the at-fault party - which would trigger their filing an insurance claim with their own insurance.

    Floyd, so sorry for the loss of your son. As surviving family of the victim, you may also qualify for crime victim compensation to assist with funeral expeness, any medical expenses incurred due to the incident, and counseling for yourself or other family members, even if the offender is never apprehended. You can contact the victim comp office of the attorney general at 800-983-9933 (statewide) or 512-936-1200 (in the Austin area).

    What I meant was, the insurance typically has no reason or desire to adjust a claim when the statute of limitations has passed.
