    Default H4 to L1 Petition

    I am on H4 visa in US since a month.
    I came to US on long leave.
    My company has filed L1 petition when I was in India. But due to emergency I dint apply for L1 B visa and I came on H4 visa to US.

    Now my question is
    1) Can I apply for L1 visa from US itself without going to India for L1 B stamping
    2) Is it possible for me to work in my company with the L1 B petition with out the L1 stamping.

    Waiting for your reply. Its very urgent.

    I'll assume that your work history with the company is sufficient to qualify you for the L1 visa.

    If we are talking about a blanket L1-B visa, you must go back to India to get the visa stamped. If we're talking about a named petition (a L1-B petition specifically in your name) submitted to USCIS for approval, you should be able to change your status from H4 to L1-B from within the U.S., and start work once you receive the approval notice and new I-94.

    If it's urgent your employer's immigration law firm should be able to assist.
