    Default How To Keep a Spouse From Taking Your Child

    My question involves a child custody case from the State of: Washington

    And no this question isn't for me- What are the rights of a parent (mom) who is trying to keep her husband from just taking off with their daughter? Dad has a history of abusing drugs and has apparently returned to using them. He hasn't been home since he started doing them again and the mom is afraid he's going to take the child and not bring her back (I told her from a court's standpoint because they are still legally married he has just as much right to her as she does). She wants to get something giving her custody because for all intents and purposes they are split up, but she isn't filinf for divorce (yet). What can she do? Anything? I don't know Washington laws at all and I don't know if this matters any but the father is Native American. I guess I'm trying to figure out if there are different rules that apply to this situation because of that or because it's not on a reservation they would be the same as any other non-Native person? (She is not Native) I don't know what to tell her and I don't want to tell her the wrong thing.

    She needs to meet with an attorney and file for divorce and ask for temp custody of the child.

    She can also get a temp parenting plan put in place before divorce is filed.

    However, if Dad runs and takes kiddo to the Res, all bets are off. She will NEED an attorney - because that's going to get murky very, very quickly.
