    Default Filing for H1B While on OPT, and Timing of Travel

    Hello,

    I recently completed my Master's in USA and am currently on OPT, employed full-time. I have not yet filed for this season's H1B.

    I need to travel to my home country during the first two weeks of July. Would it be better to have all my H1B papers ready and
    wait until I return to apply ? Or, do you think it's alright to apply for H1B before I leave (considering the cap this time has reached
    48400 for reg. and 17500 for MS) Will my travel outside the country cancel my H1b application in the latter case ?
    how about the new I-94, is there something we could re-send or attach to my original H1B application ...

    could you please kindly clarify the above?

    P.S: I have a valid F1 Visa, my OPT expires only in December this year, also, I traveled briefly in January under similar circumstance that
    is on my OPT, did not have any problems as I had a solid job offer letter to show. But now, I need to consider applying for H1B ....

    The quota is rapidly filling; your employer should have filed long ago. If you do not now have an offer and H-1B in the works, you may be heading home after your OPT completes.

    Travel will require that the filing be for consular processing rather than change of status.

    Thank you very much for the reply.

    Yes... H1B is in the works, but I have not yet used my STEM extension on OPT.
    That I believe, still gives me a chance to apply for next fiscal year, in case I miss this one.

    But, one question, will I have to do consular processing even if I apply successfully this time ?
