    Default Wage Garnishment and Moving To Texas

    I received a judgement against me for wage garnishment and I live in California currently. If I move to Texas working for the same employer, will the wage garnishment still hold in Texas. Please let me know. Thanks.

    The judgment creditor would have to seek to enforce the court order through the Texas courts. It is my understanding that Texas does not permit wage garnishment.

    Although, I am not positive of this, but I think that they can still garnish your wages through the company's physical location in California since the company is located in Californian and Texas with the judgment being in California. It is the same legal entity in both states.

    I know that you can garnish a bank account in this way.

    I know that this is an old post but I am curious to whether or not it is possible to garnish an individual's pay in this manner.

    For individuals living in Tx. who are paid from an out of state location there
    is case law to support taking a judgment from Tx., domesticating the
    judgment in the foreign state, then filing the wage garnishment there. Many creditors have apparently used this strategy successfully. That's all I have to contribute.

    I'll do some more digging and see what I come up with. This would be huge if it can be done. Dealing with transferring judgments looks like it can be a major pain plus it looks like some states make you hire a lawyer to process the foreign judgment in their state.

    Thanks for the indication that there has possibly been at least a couple if cases that may have set precedence in this matter.

    For individuals living in Texas who are paid from an out of state location, there is case law (Baumgardner vs. Sou Pacific 177 S.W. 2d 317) to support taking a judgment from Texas, domesticating the judgment in the foreign state, then filing the wage garnishment there. Many creditors have used this strategy successfully.
