    Default Emancipation in Illinois

    I'm 16 currently but turning 17 in 3 months. I have read the Emancipation of Minors Act for Illinois. I fully understand it and I still do plan on filing for Emancipation , but I do have questions. Can the judge deny the file for emancipation if there is No neglect in the home ? Also I live with my aunt and uncle. I have heard that they are filing for legal gaurdianship of me. Dont I have say in this ? I feel that im independently well off , though my mother and aunt may deny that statement. If there are objections when I do file from my mother ,and guardians ( which there will be) will the judge automatically deny my file for it? It is true that I have no where to stay or have financially assistance but if given a chance I can make it work. Im mature enough to take care of myslef. I do have goals but it is stressful living in conditions ( that are not Bad) but are not suitable for me. I want to be sucessfull but if there are road blocks how can i reach my goals. Even if it means not having ties to family members. Its not a case of freedom or having fun but a right. I have a right to say where I want to be and how I will get there.

    The presence or absence of neglect in the home is not an element of what a court must find in order to grant emancipation.

    I agree with Knowitall. I also must add, that your intentions will not get you emancipated. You must have a job at the time of the emancipation request, and show the judge that you can live on your own (no help from anyone, including the government). You must also show that you are mature, and doing well in school (the judge does not want to emancipate a child, just to see that child drop out of school). You must also not be in trouble with the law. The whole purpose of emancipation, is supporting ones self, and not needing any guidance in life, so what you do and your work habits will be some of what the judge looks at. Good luck to you!
