    Default Person Caring For My Horse Sold It, Claimed it Died

    Last year back in Oct. I let a friend of mine barrow my horse so she can use him to ride. However at this time I couldn't afford my horse at the time because I had no job/time. In the beginning we talked of how everything is going to work about but now everything is a verbal agreement. We talked about you are doing a 'free lease' on my horse and that I still own my horse and when I want him back I can take him back. My friend even said that samething when I want him back I can come over and get him and I have a witness stating that she said that.

    Now six-seven months later I found a decent job....I want my horse back. I tried getting a hold of this friend for the past two weeks I was telling her I'm going over to see my horse and I want to ride him. I gotten a text message from her 'Doc and spot are not available.' Doc is my horse, I texted her back asking her 'what do you mean my horse isn't available?'. She texted me back saying my horse went to camp. Two days later I called her up telling her I want to see my horse, she tells me my horse fallen on the trails and maybe broke his leg. And then she tells me that my horse died from a twisted gut from the 'fall'. I asked her four times I want paperwork from a vet and I want to see my horse dead so I have prove that my horse is dead. During the four times I asked her she never gave me an answer and she would change the subject.

    The next day I heard from a friend that my horse is alive and that she sold my horse. I also have heard from a friend that she has done this several times where she will tell the owners the horse is dead but the horse isn't she sold the horse. After that I went to the police to file a report that she told me my horse is dead and I want answers. She told the cops that my horse is dead and then the next day since I wasn't getting anywhere I went to the town court to file a small claims court to either get my horse back or $2,000 (how much my horse is worth). I have paperwork of this horse (coggins,rabies,pictures that I own this horse). Now last week I heard from a friend that she sold my horse for $300! but yet she told the cops that my horse is dead! But yet she told EVERYBODY else that she sold my horse. Ok, my horse is technically stolen property! I want my horse back, I never gave her paperwork stating that I sold her my horse, so I want my horse back.

    About a month has gone by and nobody knows where my horse actually is. I've been looking at the brokerlots for my horse. The court date is June 19th and I am nervous I really want my horse back. Who do you think is going to win the case? Me or her? I also have text messages from her saying that my horse went to camp and I have a witness when she told me that I can take my horse back. And I also filed a report to the cops.

    what state is this? Equine laws vary by state.

    No, it isn't. You let her take the horse which removes the possibility of her stealing it. There could be other applicable laws but it isn't horse theft.


    so, where do you stand with the small claims case? From what you have described, that is exactly what I would suggest you do. It won't get you your horse back but if believed, it would get you the money.

    This is New York.

    I didn't give her my horse, I let her barrow my horse. If I sold her my horse I would have given her a bill of sale-well I didn't sell him to her. I even have a witness when she told me that whenever I want my horse back I can come and pick him up. I even have a police report well I have to get a copy from them or I don't know if they will give it to the court. But they also have spoke to her ex boyfriend and even her ex boyfriend claimed that she sold my horse. They were given names of who the horse was supposively sold to but nobody is telling the truth of where my horse is. Either he can be in Pine Bush or Monticello or he can be anywhere at this point!

    I even told the officer all I want is my horse back or the money. I have been going thorough a lot of trying to get my horse back.

    you willingly relinquished possession of the horse to her.

    I never gave her a bill of sale.
    I never said you sold the horse or transferred title. I couldn't even address that without knowing what state this involves.

    I even have a witness when she told me that whenever I want my horse back I can come and pick him up.
    well, apparently she lied. Now you can demand the value of the horse. I'll have to look to see if you can seek an order to demand she the return of the horse.

    what court have you filed in?

    This is in New York state. The first day when I filed the report to the police they told me I can get the value of my horse he is worth ($2,000). I went to the town court and I filed a small claims court for $2,000 to either get my horse back or the money. I don't know how that is going to work. But I have a witness, paperwork (coggins and pictures that this horse is mine but no bill of sale the horse was given to me). And also I need to get a copy from the police report.

    Now if she doesn't show up to court what will happen then?

    if she was served properly, it is up to the judge. You can ask for a default judgment which should be granted unless the defendant was granted a continuance.
