    Though it is likely grounds for an assault charge against your boss, with witness's supporting your testimony, it will likely not get you unemployment, if you quit.

    Default Legal for Supervisor to Put His Hands on My in a Hostile Way, What Are My Options

    My question involves labor and employment law for the state of: pennsylvania
    This morning at 130 am my and my supervisor were slightly arguing, I tried to get away from him by walking to another truck, he follows and says you better quit running your mouth. I say I'm not. He then says in an angry voice don't piss my off ill bust your face off the back of the truck, I say will ya? Instantly he grabs me by the back of the neck and forced my face towards the truck. I put my hands up and stopped it. He then starts pushing my and telling me to get out... then walks away. I didn't put my hands on him. No police report filed. Nor did I talk to the head boss yet. There were also three witnesses. And atleast the pushing would have been caught on camera. This guy was made supervisor three days ago and just went power hungry. Honestly I wanna quit and collect unemployement. This was the last straw for me with this company. Any advice would be greatly appreciated.

    Also I want the supervisor fired and the boss to pay if he takes his side in this matter.. I think its untolerable behavior

    You are free to make a police report. Whether they will do anything about it is up to them. They are not required to.

    Nor is your employer required to fire the supervisor or his boss. And if you quit, unemployment is NOT guaranteed.

    I would guess the chances of the super's boss being fired to be equal to the chances of those souls in Hell getting their wish. It is more reasonable to think the sup might be fired but you have no say in the matter. It is entirely up to management.

    I also think the acts are INtolerable but other than filing a police report, there is little you have to say about what happens. I would suggest not quitting though. Depending on what actions the management takes, quitting may not be justified.

    Nothing in employment law makes it illegal for your supervisor to assault you in the manner he did. This is a criminal law issue. You are free to file a police report and you should report the incident to your supervisor's boss and/or human resources. If there were any witnesses to the altercation, be sure to tell the boss/HR who they were as I'd guess your supervisor is going to deny the whole thing.
