    Default What is the Chance That a Substance Exposed Newborn Will Be Removed from His Mother

    My question involves child abuse or neglect in the State of: Virginia

    History: My cousin has been a heroin addict for over 10 years and has relinquished her rights to her first daughter. She is currently 35 weeks pregnant with baby #2. I am sure the mother and child will both test positive for illegal drugs after birth. In Virginia this is considered child abuse.

    What are the chances that the baby will not be able to go home with mom from the hospital? Will the mother be offered a "plan" in order to regain custody or since this is considered child abuse in VA will the baby be automatically removed with little investigation?

    Chances are good that mom will be going home without this child. Odds that a plan may be offered depend on lots of factors, including how long ago she gave up the other child and under what exact circumstance, along with the available resources in mom's area - some places are more able to offer appropriate plans than others. No one can predict what will or won't happen - social services doesn't work that way - EVERYTHING is case-specific and considered under totality of circumstance, both past and present. But overall, statistically, if mom is going to remain a heroin user and keep making babies, she's likely to only know those babies for a VERY short time in the hospital.
