My question involves adoption law for the State of: Tennessee
My question is how much time must past for a Bio-father absences to be considered abandonment?
My ex has been MIA for 6 months. I can see activity on his facebook wall (so i know he is not dead) but he will not return my calls, text or facebook message concerning when he would like to skype with his son again. He moved to California 2 years ago and they have spoken 3 times over skype since then.
He is obviously ignore us and my suspicious is it is because the state of TN and CA have finally court ordered payroll deductions for his back support.
I have even emailed his mother and she is also ignoring me. I have not done anything crazy to deserve being ignored, we last spoke in December and I shared xmas pictures of our son, everything seemed cool.
Our son is about to turn 6 and keeps asking if his daddy has died. My husband has been his father for over 4 years and wants to adopted him. Its getting harder to explain to my son why his bio-dad is not here or will return his calls. I've turned here for help.
How much longer before my husband can adopt my son? We are willing to pay all of my ex's back child support through the state back to us and take care of his debt owed.
If I brought this to a lawyer is there anything that can be done? or is 6 months not enough time to be considered abandonment?
