    Question Visitation After a Confirmed Incident of Child Neglect

    My question involves child abuse or neglect in the State of: Ma

    I posted a month ago in here about my x taking my 13 year old daughter on a car ride for over an hour completely trashed until he eventually slammed into two cars at a red light. My daughter was taken to the ER where the hospital filed a 51a on him. Well they came and supported the incident, and now just waiting till we go back to court in July. My kids 13, and 11 are still scared to death that they are going to have to 1, stay with him again on weekends, and two have to get into a car with him. They are both deadest on having nothing to do with him, he can contact by phone or email and he has yet to do that. What do I think the judge will do to the visitation again when we go back?

    Did you file in court for a change to his visitation? either to prohibit him from driving with them or to supervised visitation?

    Yes, I am sorry forgot to add that. Right after the accident I went for Emergency hearing, which they temp suspsed his visition until the next Tuesday, as it was his weekend to take them. I had him served and we both showed up on court and he agreed to not see them for a couple of months, but was able to call or email them everyday with it being the kids choice to take his call or email him back, which he has done neither of those ( it has been a month). He also had to go to an AA meeting once a week and contiune with counsling. We go back in July for the next hearing.

    I do have a lawyer now, and I hope that the courts will make it be suprisved visitation ( and I will ask for it, and I assume from what the DCF worker told me, they are reccomending them to be supervised visits as well ) and not just toss this incident under the rug and let him have full visitation back.

    Just wanted to know if the DCF report will hold in the court? Do they judges look at it or do they make their own judgements on what they feel is in best interest of my children when it comes to their saftey?

    Both.

    The judge will (a good judge, anyway) consider the DCF findings, and consider the best interests of the children.
