    Default Joint Tenancy Problem

    My ex-girlfriend and I have owned a home as joint tennants and common for the past 5 years in Kentucky. We were engaged to be married when the home was purchased. Our romantic relationship ended when I caught her conversing with other men on the internet. Since that time we have lived together as roommates rather than boyfriend/girlfriend for the most part. I do not particulary like this arrangement, but it is one of convenience.

    Now, she is telling me that her online lover from Europe is comming to visit for two weeks next month. This is where I draw the line. I can't stand the thought of my ex (who I still care for) being with this man in our own house. More importantly, I don't want what I consider to be a total stranger having access to my house. I've tried to calmly express my views to my ex, but she becomes very defensive saying that she has just as many rights to who comes into the house as I do and I have no control over who she brings in.

    Do I have any rights in this case? What can I do to keep this person out of my house? Is it possible for me to take out a restraining order or something against them?

    It's not your say, who your ex-girlfriend has as a house guest. As you apparently didn't draft a contract to cover how a buyout might occur, or what other disposition might be made of the house, when you bought the house together, you're in a difficult position. You can make an offer to buy her out, see if she will make an offer to buy you out or to sell the property and divide the profits, or spend the money necessary to have a court order a buyout or sale.
