My question involves a child custody case from the State of: Florida
Hello. Can someone please tell me the Florida laws on custody and abandonment by the father?
My daughters father and I split up before she turned one because he started using drugs. When I left her told me to leave and that he never wanted to see me or my daughter again. After that he sent texts telling me that things like, he has watched CSI and could kill me without knowing. The first year I spent trying to make him be in her life, I would bring her over to to his moms when he was there to see her, or let his mom keep her for the night so he could see her, but he wouldn't have anything to do with her while she was there, he would just worry about what and who I was with and his mom said when she was there he would just leave with his friends. One of the last times I took her there he got mad because I wouldnt have dinner with him and threw a beer bottle at me with my child in my arm. After about a year of that his mom sent me and email and asked for me not to bring her anymore because she feared for my daughters safety being there with him messed up on drugs. These days I fear for my life that he will get messed up on drugs and come and hurt us. I have tried filing for restraing orders, but they get dropped because he can not be found to be served the papers.
Since then he has not attemped to contact me or my daughter except when he goes to jail, then he will write a letter. He is in and out of jail for domestic violence on his girlfriends and other people and multiple drug charges. The only time he pays child support is when he is arrested for not paying and has to pay a certain amount to get out of jail, he is currently behind about $15,000.
I am getting married in November and have a great father figure that would love to adopt her, but her biological father will not willingly sign over rights, just because he wants to make my life miserable.
My question is, is there any legal way to have his rights revoked?
