    Default Should I get emancipated

    My mother is taking things out of control, and she thinks she can always get her way. When ever she dosent she gets pissed off. She has me do all the cleaning and I mean the entire house like I have no home work to do. I'm sixteen and pregnant and want to finish school, but my mother wants to pull me out and put me in a trade, given she didnt finish high school herself. She tell me she wants the best for me but I know that that Isn't the best. all she dose is yell and verbaly abuse me when its not what she wants. All thier is, is yelling where I live in now, and i dont need that stress on me. I have my fiance but she threatens to put him in jail if i dont things her way, and he wants to take the responsiblity of the baby coming and me. his mother is willing to help me to.

    should i file for emancipation and what do i need to do it (qualify and such)

    You're in Florida - your parents would have to initiate the emancipation process under Florida's statute.

    I am no lawyer but in most states you need a job and a place to live before you can get emancipated. If things are really that bad you should call child protective services or whatever it is in FL. If you have any family you can live with, that will make it much easier.     How old is the boyfriend? The reason why I ask, is if no laws were broke, a judge may issue you a marriage liscence, if you two are the parents of a child, if you are 16 or older in Florida. This is purely at the discretion of the judge, so if he is older than you, and a child molester, it is not an option at all. If things are o.k in the age, and your boyfriend could prove that he could provide for you, without the help of anyone (the state included), then if your married, your pretty much emancipated. I have strong feelings against this, but this is not why I am here. Please, other senior members, if I am wrong in any way, please correct me. I am only showing this because someone showed it to me when discussing this dilema. I would love to be wrong!

    Title XLIII
    DOMESTIC RELATIONS Chapter 741
    MARRIAGE; DOMESTIC VIOLENCE View Entire Chapter

    741.0405 When marriage license may be issued to persons under 18 years.--

    (1) If either of the parties shall be under the age of 18 years but at least 16 years of age, the county court judge or clerk of the circuit court shall issue a license for the marriage of such party only if there is first presented and filed with him or her the written consent of the parents or guardian of such minor to such marriage, acknowledged before some officer authorized by law to take acknowledgments and administer oaths. However, the license shall be issued without parental consent when both parents of such minor are deceased at the time of making application or when such minor has been married previously.

    (2) The county court judge of any county in the state may, in the exercise of his or her discretion, issue a license to marry to any male or female under the age of 18 years, upon application of both parties sworn under oath that they are the parents of a child.

    (3) When the fact of pregnancy is verified by the written statement of a licensed physician, the county court judge of any county in the state may, in his or her discretion, issue a license to marry:

    (a) To any male or female under the age of 18 years upon application of both parties sworn under oath that they are the expectant parents of a child; or

    (b) To any female under the age of 18 years and male over the age of 18 years upon the female's application sworn under oath that she is an expectant parent.

    (4) No license to marry shall be granted to any person under the age of 16 years, with or without the consent of the parents, except as provided in subsections (2) and (3).

    Well there you go neadhelp. The answer to your prayers.

    (a) To any male or female under the age of 18 years upon application of both parties sworn under oath that they are the expectant parents of a child; or

    (b) To any female under the age of 18 years and male over the age of 18 years upon the female's application sworn under oath that she is an expectant parent.
    Looks like you can get married whether mom and dad care or not. So go on out there and marry your fiance. Join the real world of taxes and bills and not enough money to buy food AND diapers.

    Even if the daddy is under 18 you should be good to go.

    Good luck and enjoy the next 20 or so of the hardest years of your life. It doesn;t magically get better just because you are married and not living with your mom.

    I wonder, if the boyfriend is to old to be with her, that when they apply to be married because she got pregnant by him, that the judge will have him arrested for statuatory rape?
