    Default H1 petitioner's rights

    Hi
    If my current employer has petitioned for my H1, can he hold my approval notice or is he obliged to send it to me.
    The reason I ask is because another company is willing to sponsor me but I feel I might have a hard time getting my approval notice(from my current employer) to file the transfer(with the new company).
    The form I-129 only asks for the Approval/Application number. Do I really need to have the approval notice for the transfer.
    Can someone spare a few minutes and throw some light on this.

    If your employer won't provide you with your I-797 approval notice, try using form I-824 to request a replacement

    Thanks for the reply.
    but the other question remains. Isn't the employer violating any rules by
    not releasing the I-797.

    I've never researched the issue. You can see if somebody else responds, or ask the USCIS.
