I own a few chickens and I live in a borough in PA. I went through the procedure outlined in the town ordinance, Housing was inspected and approved by board of health and permit was approved by council. The conditions are that I can have 12 chickens, no roosters, and they must be contained. I have them in coops/pens that are padlocked and totally enclosed so no chickens can get out and no one can get in.
My wife andf I each recieved a $655.50 fine for a chicken pooping in a lady's yard. I was confused about this because my chickens are contained and they were at a local fair on the date on the fine. I asked the officer who issued the fines and he assumes it was my chickens because I am the only one who legally owns chickens in my town. I asked if anyone got pictures or a description of this alleged chicken, he said no. Another officer in the station told me about another fine I will be recieving for the same thing and the same lady's yard. He claims to have seen the poop.
I assume the law is that the person or officer who complained will have to prove it was my chicken. Since there was no picture taken or description given this will be an easy win for me. I can prove where my chickens were at the time of the alleged pooping incedent and I will have pictures of all chickens I have ever owned with me at the hearing. All of my chickens are banded for identification with PA department of agriculture bands when they were tested for diseases like bird flu.
