    Unhappy B1/B2 Eligibility for Observership in the U.S

    Hello..

    I am a doctor from India. My case is a little complicated..

    I was issued a b1b2 10 yrs multiple entry visa in 2009 when i got an medical elective at harvard (elective: doing a rotation in a US hospital without being paid.. u see patients with doctors there).. i had rotation in march and june 2009.. so i travelled twice in 4 months.. stayed 1 month each time.

    a year later went for my CS exam (clinical skills exam of usmle) came back in a couple of months..

    8 months later i got accepted to work as a research volunteer (was not paid) at harvard for a year.. i went on a J1 visa to which 2 years home country restriction applies..

    i came back in february this year.. and just before i was suppose 2 fly.. i lost my passport.

    I did not get my medicine residency this year unfortunately.. so to improve my CV.. i got 2 observerships ( u observe an attending physician see patients but do not get involved in patient care in any way)

    now i am applying for b1b2 visa with observership as the purpose of visit.

    I am very apprehensive that my multiple visits in the past and the lost passport history could result in a rejection.

    please advice.

    P.S: i have passed all my usmle steps with stellar scores but my luck is playing serious games with me in the recent past.

    Apparently no issues or concerns were raised during your past visits to the U.S. as a tourist, so I'm not sure why you believe there would be a problem now. Those visits would presumably have been considered when you were granted the J1. If there are facts you have not shared, consider discussing them with an immigration lawyer.

    In terms of your loss of your passport, the issue remains whether or not you overstayed. If you did not overstay but are concerned that your lost passport and I-94 may create confusion, be prepared to document your actual departure date so you can prove you did not overstay.

    well.. i have never overstayed.. but i dont have the copies of the stamped pages of my passport.. however when i came back last time.. since i did not return my i94 which was lost along with the passport.. i preserved my boarding pass as a proof.. i am afraid i cannot produce any documents for the previous visits.. i do remember the exact dates of my travel though..

    also.. i will be applying for internal medicine post graduation on september 15 (i want to go for this obsevership to improve my CV) of this year.. so i am worried that might be perceived as immigrant intention..

    the worst part.. i am single and unemployed at the moment since i struggling to get a post graduation position.. i have heard these r the top reasons for rejection.

    there is 1 thing.. i am under my 2 year home country restriction after my j1 visa .. will that be in my favour? since i cannot apply for immigration even if i wish to
