    Smile Married to a Permanent Resident Marine

    Hello! I'm married to a permanent resident Marine, he joined in January 2012 and will be done by July. He submitted his paper work to get his citizenship and they told him that around June might be ready. I have my I-94 which expires until September, and we want to submitt my immigration papers before it expires because we don't know what happen if it does. We've been told that doesn't matter that he's a permanent resident because now that he's in the military, my process will be as long as 6 months like if he was U.S. citizen, is that true?. We know that for a permanent resident the process takes around 5 years and we don't want that. What happens if my permit expires and we haven't process my immigration papers? should we wait until he gets his citizenship or can we do it now? What do you suggest us to do?. I appreciate all your help. Thanks

    You're in the U.S. on what type of visa / status?

    Has your husband tried contacting the USCIS Military Help Line, 877-CIS-4-MIL (877-247-4645), or speaking to the USCIS liaison for his base?

    My visa is a b1/b2 and expires 'til 2019

    We haven't tried that, im gonna tell him to call or go there. Thank you so much =)

    Your visa is valid until 2019, but your authorized stay ends when?

    My I-94 expires in september 29, 2012

    If you marry and petition to adjust your status before your I-94 expires, as long as you don't travel internationally without advance parole, the Sept. 29 expiration would no longer be an issue. If you petition for adjustment of status then leave the U.S. without advance parole, you can expect to be denied reentry on your B1/B2 visa (a non-immigrant visa) due to your declared intention to immigrate. If he's going to naturalize sometime in June, there should be no problem filing before September 29; but if you qualify to adjust your status based on marriage it's possible to petition despite a B1/B2 overstay.

    I cannot promise that your petitioning to adjust your status shortly after entering on a tourist visa won't create potential issues, although as I'm sure you've seen from the many forum discussion threads on the issue, people routinely navigate those issues and succeed in adjusting their status.
