    Nobody can answer that. It depends on how much the judge has on the table. Early release is a small issue to focus on when the judge has a full call, violations, continuances, new arrests, trials to commence, etc... Your request can take months from start to finish. Hell, it may not get a response at all.

    I was hoping for a better answer than that, maybe from people who have been on probation in Wisconsin and have successfully been released early... I'm moving to NC regardless if it has come back on the 2nd I have decided. I haven't had any violations, have paid all of my fines, probation fee's, and during my probation I had re obtained my license and been overly successful as far as everything probation is concerned... My mom was in bad health in february in the ICU on life support and is off and better but has multiple chronic illnesses that my P.O is aware of, I had planned on moving on the 2nd and this all being taken care of but my P.O had the wrong information and told me to write the judge myself asking for early release which took up a good portion of the month waiting on a response only to find out that she had to send in the request herself(she also told me that the process should be fairly quick, within a week or two and that under the circumstances I would more than likely be released and that I could make plans to move). So now as it sits I have to be out on the 1st, and my only option is to move to NC as my landlord has found another tenant and it's too late in the game to apply for a state transfer. If the population is only about 28k and the court system is relatively slow, how much time could I look at and what are some realistic options. Also if it's sent to the judge already, and then I abscond and she puts a warrant out for absconding.. and then the judge approves the release would the bench warrant for probation absconding go away?

    If you violate your probation before you are released (and I have to assume that leaving the state would be a violation), you PO would be duty bound to issue a warrant for your arrest. And, no, if your early release comes through after the warrant has already been issued, the warrant isn't just going to go away. The violation occurred while you were still on probation. Even if you violated probation just days before the end of your probation (even without early release), it is still a violation and subject to the full wrath of the court.

    I know you say that you have already decided to leave whether the early release comes through or not. But, have you really thought that all the way through? Have you truly considered the consequences of violating your probation? It means that all the time and effort you have put into meeting the conditions of probation up till now will all be wasted effort. If you already have a suspended sentence, then it could be unsuspended and you would be subject to the full jail time and/or fines that the judge suspended. If, perchance, no sentence was stipulated and then suspended pending your successful completion of probation, you would go back in front of the judge for imposition of sentence...after now pissing the judge off by pissing away the break you were given. To top it off, at the completion of your sentence, you will likely be put back on probation again! At the very least, you can expect to void any early release that a judge may have signed and have your original probation period extended.

    My advice would be to crash at a friend or relative's pad and adhere to the conditions of your probation until you have official release documents in hand!

    My previous P.O before I moved here had told me that Wisconsin wouldn't extradite me from NC for a misdemeanor warrant, so I'm not really worried about the ramifications too much, at least for now. I would rather NOT have to abscond but I moved to this location for a job that ended, and I have no friends within 3 hours of where I'm at, much less any that would let me and my family of 5 crash. As previously stated I have no want or desire to abscond for the sake of absconding but I'm really at a crossroads as to what path to take as I can't stay here and moving could theoretically screw me out of potentially having a grand and blissful life. I guess I can just pray that the early release goes through before my P.O takes notice of my absconding, the court system here isn't overly busy(small town, minimal crime) and I have until the 6th for it to completely go through before I find myself in any kind of situation that will arise and even longer if I can reschedule my probation appointment.

    I was on probation back in the day and requested an early dismissal. The first request was denied by a judge about two weeks after I made the attempt. About a year later, another request was made and it was approved by a (different) judge about a week later. You own experience may be similar or different--there is absolutely no way to tell. Presumably a small town might move quicker on these types of cases. Good luck!
