    Default Child name changes

    Can a mother add her current husband's last name to a birth certificate without the father's consent?The mother's madien name was listed as the child's last name. What if paternity was never established? Would the court have to find the man believed to be the father or terminate his parental rights? Thanks!!!

    If a child is born within a marriage, paternity is presumed.

    The mother and father were never married. The mother later a differnet man and then had his last name added to the birth certificate. The child was originally given the mother's last name and it is now her last name and the step father's last name.
