    Default Speeding Ticket Discovery in Washington State

    My question involves traffic court in the State of: Washington
    Hello everybody,
    I need some help with my situation:
    on April 13th I was clocked doing 77mph in a 50mph zone by an oncoming police car on highway 2 in Leavenworth.Mailed my contested ticket to the court and rescheduled the hearing till May 17th.Also,did a discovery request using the form I found on this website,mailed the forms via certified mail.The online receipt shows that the letters were delivered on April 26th.Today is May 14th and I still haven't received the discovery.Also,I know you can contest your ticket in writing in Seattle,was hoping to do the same with Chelan court but found out that only option in writing is to mitigate.Do I still have any options? Since I don't have the discovery,I don't have any ground to contest my ticket.

    Unfortunately, You need to drive all the way out to the court and attend your hearing.

    Before you leave, print out the proof that it was received more than 14 days before the trial by the Prosecutor in charge of the infraction.

    When you get to court and your case is called say, "Your honor, I move to dismiss the infraction under IRLJ 3.1(b) as I have not received discovery materials from the prosecutor. If I may approach, I have proof of service of the discovery request."

    This case MUST be dismissed unless you provided the wrong address or you haven't checked the mail. And if you're whining about the $60 in gas that you spend driving out there, well, I'd spend $60 in gas to save $200 in fines and $1000 in insurance increases.

    Just had a thought:so,it's still two more days till the court date,what if the discovery shows up? Can the ticket still be dismissed based on the 14 days period?

    I just noticed you say "...and rescheduled till May 17th." Did you mean "...and they scheduled my hearing for may 17th"? If not, did you request this date, or is this just the date they gave you?

    Also, you say "letters" (plural). Did you send a copy of your discovery request to the court to have them file?

    The 17th was just one of the available dates,actually the latest date available.So,I guess I requested it? As for the letters,I mailed two-one to the court,the other to the prosecutor's office.
