    Default Can I Plead Not Guilty to MIP for Alcohol and Win

    My question involves juvenile law in the State of: Oregon, I recently got an MIP for alcohol I was with a couple of friends in my car, my friend had a paintball gun with him and shot off a few rounds outside the car window. next thing I know fhe cops pull us over and confisicate my friends gun and the cops say they smelled weed in the car ( even though my friends and I dont smoke ) they ask to search the car and I say go ahead but what I didnt know was that my friend had a couple 4 lokos in his back pack that he didng tell me about. afterwards the cops take my friends and to a holding center and give us all mips even though none of us were under the influence and my buddy and I had no clue that are 3rd frienad had alochol in his back pack. so can I plead not guilty for not being under the influence ans' not jnowing about the alcohol. this is my 2nd mip and I dont want to lose my license so any advice will help.

    Not being under the influence is completely irrelevant. You were charged with possession, not intoxication. The argument that you didn't know about the presence of alcohol will come down to your credibility with the prosecutor/judge.

    That's not going to help with your credibility. The circumstances certainly imply that you were aware of the alcohol and it was intended for the consumption by everyone in the car. You are usually legally responsible for anything in your car. You were with two other underage guys, behaving in a disorderly manner, and there was enough alcohol for everyone. The only thing you have to counter these circumstances is your word (your friends' testimony won't carry much weight since they can be expected to lie for you). So, basically, your only defense comes down to your credibility.

    since this is my 2nd mip I am most likely to lose my license do you know any way for me to not lose my license by doing either like extra comminuty service or anythin I just domt want to lose my license.

    No. Losing the license is mandatory.
