    Default Is Landlord Responsible to Replace Broken Washer

    My question involves landlord-tenant law in the State of: MA I moved into an apt. which had a washer/dryer unit in the kitchen. It stated in the listing for the rental that this was included in the apartment. However, it does not state anything in my lease about appliances at all. Shortly after moving in, the washer broke, landlord has been saying for 4 months he will replace it when he has the money.. I have been spending $70/month at laundrymats each month. Now he is not responding to my calls or emails at all regarding this.. I cannot just replace the washer myself since it is only a small space large enough for a stackable unit and no other hookups, I would have to replace both the washer and dryer. I am on section 8 im a single mom and just dont have the money to spend at the laundrymat, ive been begging him and been very patiently waiting for 4 months but now he is avoiding me all together. Please help.. im wondering if I have any recourse..

    thank you so much, i read that and my situation is rather complicated unfortunately and since Id rather not take legal action I dont think theres much I can do. A few months ago I had asked him if we could have a kitten here and he told me as long as we dont have a dog, he didnt mind (his other tenant downstairs has 2 cats). So we got a kitten a few weeks ago. It didnt even occur to me at the time to get anything in writing about pets, and figured he wouldnt give me anything in writing anyway, so I didnt ask him for that..Im realizing now that I shouldve. After 4 months of him telling me the washer would be replaced when he has the money, now that Ive made a comment to him about possibly needing to deduct some of my next months rent to defray the cost of what Ive been spending at the laundrymat, now he is saying that I am violating my lease by having pets. And that it states no where in my lease that he has to supply a washing machine so he is now not replacing it. Basically he's retalliating, because if I wasnt complaining about the washer, he would not be complaining about the cat. Its really unfair. Now I have to replace the washer AND dryer and can only get a stackable unit which are pretty costly, as theres is only room for that. Im in a lose/lose situation.

    ............and my situation just keeps getting better! now that Ive found one on my own and put a deposit down on it, I came back to home to double check the plug/outlet situation, to find that he had the washer/dryer unit somehow plugged into a regular 120 volt outlet the whole time. NO ONE would believe me when I told them this. Just had an electrician friend come look for himself. He said what the landlord apparantly did was change out the cord/plug from the old unit so that he could plug it into a regular wall outlet. Which is extremely dangerous. No wonder why he wont replace the machines now, he would have to do that all over again. AND now I cant even replace them myself, I have to pay an electrician to somehow have this outlet re-wired to correctly support a 220 volt machine. Is this something that the board of health needs to get involved in? I just dont know what to do. LL just keeps ignoring me and saying he isnt replacing the machines.
