    Default Can I Publish Content from Ebay

    Hey all,

    eBay User Agreement says
    "you will not [...] copy, modify or distribute rights or content from the eBay sites, service or tools or eBay's copyrights and trademarks;"
    therefore can I analyze and publish number of auctions or calculate average listing prices of particular item and make it public ? Or any other results based on auctions listed on eBay.

    By publishing I mean posting on my blog and sending to another bloggers and portals.

    Sure, you can do statistical analysis. You just can't re-publish any of eBay's content, such as photos, auction listings, logos, etc.

    You've got both ebay and the seller to worry about. While the seller's grant ebay license to allow their stuff to be listed, that doesn't necessarily mean it extends to other people who happen by the site.

    Note, if you're going to mine the site in any sort of automated fashion it would behoove you to inquire and use the Ebay SDKs for doing so. They can terminate your access if you beat up their servers outside of their guidance.

    I haven't used eBay in a long time, but I think they have widgets and other tools to post auctions on other sites or send links, etc. to people through email. You can still do your statistical analysis, but I don't think you can post or publish things outside of the widgets eBay lets you use unless you own the rights to the content.

    You can link to content on eBay. I do searches all the time on google, etc. and eBay listings come up on other people's pages, usually framed with their own content. The proliferation of it rather demonstrates there is no licensing or controls in place and eBay likes the exposure. You could certainly do statistics and show eBay auctions within your content. I have been a power seller on eBay for a number of years, have an Amazon store, buy.com, etc.
