    Default Whose Information Should Go On a Rent Application

    My question involves landlord-tenant law in the State of: California

    As a young landlord myself, I had only rented out a single unit to tenants in the past and am in the process of renting out another. Recently, I came across a very interested tenant who was looking to rent a unit for her mother. While filling out the application, she wrote down everything according to her own information, instead of her mother's. She claimed this was because her mother was retired and was not receiving enough income to pay the rent. I was wondering if on the actual lease, she is supposed to do the same and write down her own information or her mother's?

    Any advice is greatly appreciated. Thank you in advance.

    I would think you would want information for both parties - the person paying the bill, and the person living in the unit.

    Put both names. If any problems arise down the line and an eviction is necessary, you'll want both people to be on the lease.

    It would certainly make sense to have the payor commit to the lease as a guarantor of rent. If you have a binding commitment to pay the rent on behalf of the tenant, it's not necessary to make the guarantor a tenant in order to enforce the promise to pay.
