    Default Roommate Wants to Renew the Lease with Someone Other Than Myself

    My question involves landlord-tenant law in the State of: Kansas

    My roommate and I have lived in a rental unit for almost 2 years. Our current joint lease is expiring at the end of June (in just under 2 months). We recently had a trivial falling out and she said she has decided not to "renew the lease with me". At first I thought that meant she was moving out, but then I found a post she put on craigslist, 5 days prior to even telling me she wasn't going to renew the lease with me, searching for a roommate to move in to my room. She even put that she is looking for a new roommate because I am moving out for a job in another state (lie). I guess she expects me to move out, but I have no intention of doing so. I am going to talk to the landlord tomorrow, but based on everything that has been going on I wouldn't be surprised if she told the LL I am moving and requested to renew the lease without me. Would this be legal? I have made no indication to the LL that I am moving out or giving my notice, so my roommate cannot essentially get me kicked out of my home without grounds can she?

    Would it be legal in the sense of what? She's not going to get arrested for lying to the landlord, assuming that happened, nor have you suffered any economic harm that might form the basis of a civil lawsuit.

    Let us know what your landlord says. I doubt that the landlord is going to want to get into the middle of this dispute.

    The question is, we have a joint lease with both of our names. Can she legally terminate our lease upon expiration and sign a new lease without my name on it for the same rental unit without my agreement to move out? I did speak with the LL about it this morning and my roommate has not tried this yet, but roommate basically told me that I have to leave after june because she has a new roommate moving into my room in july. She cannot force me out, correct?

    You can't force her to continue to live with you.

    Expect the landlord to refuse to renew the lease for either of you.

    I do not wish to make her continue to live with me and I don't care if she doesn't want to live together anymore. But that is just it: since she is the one who decided this, she can move out. The landlord has no grounds/reason for wishing to lose me as a paying customer, whereas roomie's two dogs have destroyed several fixtures around the apartment. Her pet agreement states that if the pets are found to be destructive they can be requried to vacate the premises at the discretion of the landlord. I agree that the LL does not want to get in the middle of this, but since roomie is the one who does not want to renew the lease with me she can relocate and the LL has also been stressed in the past over the dogs so I believe she will see the validity in keeping me as a tenant over the roommate.
