    Default Paid After Notice Was Served

    My question involves an eviction in the state of: Georgia

    If I was served an eviction notice and paid my rent after I was served, would my landlord have to do another notice to evict me? The 1st notice was served over 3 months ago but ive been living here since.

    We're talking about a notice for nonpayment of rent, with rent now paid in full? Or we're talking about a notice of eviction because your lease has ended, for misconduct, or on some basis other than or in addition to nonpayment?

    Was a case filed in court?

    Have you discussed the matter with your landlord?

    For non payment. I paid the 1st time. It was 3 months ago. I went thru a loss and now im in the same position. We talked but shes not trying to give me anymore time. Ive been living here for a couple years and have always paid my rent, just went thru something recently.

    So you paid the rent in full, have fallen delinquent again, and are wondering if she'll try to go to court based upon the old notice? I doubt it. Why don't you think she'll serve you with a new "pay or quit" notice?

    right. she said she was gonna use the old one. i just wanted to know if i paid her, have the receipts, and she let me live here 3 months after i paid it can she use it

    Generally, in California, if a tenant pays the rent within the 3 day period posted on the notice, then that "cures" the default and the lease will continue. You would also want to see if the old notice itemized the amount of rent that was due. For example, did it say "Rent of $750 due for the month of December 2011?" Also, is the same amount of unpaid rent due now? I would advise my clients to definitely serve a new 3 day notice. Georgia law might be slightly different.
