    Default Interstate Child Support Modification / Paying Double Support

    My question involves child support in the State of: Florida
    My husband and I are currently living in Missouri the child support case was filed in Florida. Ex wife and child are still living in Florida. My husband works a full time job and a part time job. He was laid off from the first full time job where he was making decent money, and was able to find another full time job making far less than when the order was originally filed. So he picked up the part time job so he could offset the child support since so much was being taken out each week. In an attempt to modify the support order through Florida DOR they sent the same order to the part time job to hold out the full amount of child support. And they are still with holding the full amount of support out of the full time job. We are 100 percent paid on his support order...no arrears. We have been calling and calling trying to get this second order stopped but can not be anyone to send the stop payment order to the part time employer. He doesn't even make enough money at the part time job to cover what they are trying to hold out. The ex wife will not send the money back to us because she says if she sends it back she will have no proof to cover her butt that she paid it back to us , so her logic is just to keep the extra For herself while we fall behind on bills and can't afford groceries. So my question is what can we do? What are our options? Is she obligated to pay it back since its not a " gift" it was taken involuntarily. I think this is stealing. How do we stop this. I know mistakes happen but this is rediculous.

    Are you stating that Florida started to have Missouri collect the support, but has since issued its own income withholding order, such that both states are collecting the full amount?
