    Default What to Do After Defaulting on Debt

    My question involves collection proceedings in the State of: Virginia

    I came to USA on a student visa. First 2 years of my student life went very well. Had a job on campus, got good grades and stayed out of trouble. After graduation, I had a 2 year permit to work only in the field which is related to my study. It was in the height of recession, and so was unable to find work. Being unemployed, I had to rely on my credit cards for living. After a few months, I moved to chicago and then to washington DC hoping to better my chances of finding a job. Sadly, I did not get a job and it ended up costing even more for my living expenses. Time passed so quickly and my work permit almost came to end. Without a job in hand, I could not apply for extension of my work permit which means I had to leave the country after it expires. With no money left to clear my debt, I left the country.

    My total debt is: $25,000. I have stopped making payments and it has been 4 months. It is my understanding that after few more months, they would close my accounts and send it to collections.

    1. When would the SOL period start and end ? would they go by the state where the accounts were opened or my last place of residence ?

    2. If they go by my last place of residence which is virginia, How many years for SOL to expire and how long it would take for the debt to be erased from my credit report ?

    3. If I choose to come back to USA in a few years, would there be a default judgement against me ? Would I be arrested at the port of entry ?

    Please help me !

    You will not be arrested. You will come back still owing the $25,000, except the balance will be much, much, more.

    The debt can only be reported on your credit report for a period of 7 years.

    You can in theory be arrest for this debt if they get a judgement against you and you don't appear to a required court hearing for discovery of assets. However, no one in the U.S.A. can be imprisoned for a debt.

    1. It depends on the full facts and where you are sued. You moved around a lot, and many states will toll the statute of limitations for periods of absence.

    2. Most likely five years, tolled (extended) by periods of absence from the state, for any lawsuit; credit items normally drop off a credit report after seven years.
