My question involves criminal law for the state of: Nebraska
I have served a perfect two and a half years of a five year probation sentence for felony DUI.
I started in the "specialized DUI unit" where my PO told me the twice a week random alcohol testing would be periodically reduced with proper compliance, about every six months. At six months she had me dropped to once a week. At one year she rolled me down to a lower level of probation with a new PO.
I asked the new PO about a ruduction in testing frequency and he was "not inclined" at that time. Since then, for 18 months now, I have asked every two months at our meetings. He is unwilling to make any recommendation on my behalf and always tells me he CANNOT do anything. He told ME to write a letter to the judge, which i did. I gave it to my PO on October 3, 2011, and have heard nothing as of April 26, 2012.
Will going to his superviser do more harm than good?
How do i get my case in front of the judge for review or modification without a recommendation from my PO?
Do I need an attorney for that.
