    Default Finding a Prior Version of the Sentencing Guidelines

    Florida- i'm trying to find out if my husband's original sentencing scoresheet was correct. haven't been able to find anything online that would help. his case was in 1990 & now he just had his first vop. the atty says that he could get the max of what the guidelines called for at the original sentencing. do you have any ideas? (saw an old thread where you gave a link for fl crim proc.)

    Is it that you are trying to find a source for the old guidelines, and your husband's lawyer doesn't have a copy?

    I really don't know what he has. Not the easiest person to get a hold of. I'm wanting to research on my own to see if there was any errors on the scoresheet. I think that I can request a copy at the courthouse but I was wondering if you knew of any manuals online that would tell me how to fill it out.

    I doubt that you'll be able to find the 1983 version online. You may be able to access it at a law library (perhaps your county law library or a law school library).

    I'll check w/ the library. thanks for your input. I'm hoping that the info wont' be needed for an appeal. There were several factors at the onset of the case that just wasn't right. original judge didn't follow the agreed upon terms of the plea bargain & sentenced him to the max without allowing him to withdraw his no contest plea beforehand. (I've read in the Fl Supreme Court opinions that this is unconstitutional) Also, the 1983 guidelines were supposed to place you in a recommended bracket, according to your score, somewhere between minimum & max. the judge did what I think is called "an upward departure" & just gave him the max. At the sentencing, even the prosecutor stood up & objected but he wouldn't listen. just got angry & chewed her out. "who's wearing the robe in this courtroom, counselor? you or me? That's what I thought. Judgement stands. Next case"
