    Default When Can a Non-Working Spouse Get Alimony

    My question involves a marriage in the state of: California. My husband moved out of the home in Feb following less than 2 years of marriage. The problem is that he never worked during our marriage. I was the wage earner in the family. We have NOTHING to separate. He didn't have his name on anything. Now he is refusing to sign divorce papers saying he is holding out for more alimony. I thought alimony is California is determined by date of separation...is this true? Can you hold out on signing divorce papers and recieve more alimony? I already GAVE him a car that I am still making payments on. I am paying his medical insurance. I am paying his phone. I'm trying not to be mean about this, but I'm ready to cut all ties. My only fear is that he is abusive, so he may retaliate.

    Given the short length of your marriage, it's doubtful that he will be entitled to anything but very minimal support.
