    Default How to Serve Papers in a Default Case

    My question involves a child custody case from the State of: Oregon
    I filed a motion for default and filed the general judgement and the judge signed it. I was never told that I had to serve my daughters father. Was I supposed to serve him with the papers even though he defaulted?

    If you didn't perfect service on Dad - yes, he had to be served - there's a better than good chance the ruling will be overturned.

    Next time, make sure Dad gets served.

    Why was I never told that I had to? And when I asked the court, they said I didn't have to. Do I serve it after it has been signed?

    It isn't the court's job to tell you what to do.

    Who at the court told you Dad didn't have to be served? The clerks are not allowed to give out legal advice, for example.

    I served him the original petition. He defaulted. The default order is signed. Why would the judge sign the final judgement if I didn't have proof of service? I didn't have proof of servie for the final judgement paperwork?
