    Default Nursing Home's Release of Alzheimer's Patient

    My question involves a person located in the state of:Florida
    I had power of attorney. The nursing home released my mother to my brother against my request. They said that she was mentally competent to make her own choices and could not hold her against her will. She has alzheimer's and dementia. What can I do now?

    Petition the court for guardianship. If doctors felt she was okay to release, you may not get far though.

    You can seek a guardianship.

    Although I cannot see its terms, generally speaking a power of attorney deals with finances, not where somebody lives. Or are we talking about a healthcare proxy?
