    Default Do You Think the Court Would Agree with Me Getting Emancipated

    My question involves juvenile law in the State of: Florida
    Well first of all, I have already been removed from my original home by DCF because my parents were on drugs. I am currently under the custody of my grandparents. They receive my social security check but more so spend it on themselves rather than me. My grandmother is a little senile, and my grandfather is mean, arrogant, power hungry, and heartless. My living environment is extremely stressful considering the fact that my grandfather is constantly threatening to send me to foster care for no reason. He shut off my internet earlier in the year and wouldn't take me to the library to get my school work done, which caused me to do poorly in school for a little while. Now that I have learned I will not be reunified with my parents, I was thinking about emancipation. I am 16 years old, I would have stable housing (my friend who is 19, and lives with her 24 year old boyfriend, mother, and younger brother have said I could live with them.), I would receive my social security check if I were to be emancipated, I would also have a job, a car, and still be in school. Do you think a judge would agree with me getting emancipated. Also if you have more information on the subject, please let me know. Thank you. (:

    You have no chance of being emanciapted.

    You would need to show the court that you are 100% self-suffient, meaning you would have to be already working a job (for a long while) that pays enough money that you can pay market-rate rent, that you don't need you social security check (because it would stop if you were emancipated) and that you have the maturity to handle adult decisions.

    Secondly, the social security money is being spent on you. You have a place to sleep, food to eat each day and clothes to wear, and internet access when you are not in trouble.

    No, you wouldn't. If you're emancipated that means you're considered a legal adult and no longer in need of dependent benefits.

    But the whole question is moot because in Florida, unless your parent or legal guardian signs the petition for emancipation, i'ts not going to happen. Period.
