    Default How Often Can Custodial Parent Ask for Revisions to Child Support

    My question involves child support in the State of: New York

    In February of this year, my income came down 25%. I explained to my ex that I had to take this other job in order to continue employed and keep providing. She agreed to this verbally but then discussed it with her attorney who advised her to put a clause in the modification document (which we are preparing and signing ourselves) to have the modification revised in January of 2013 once I prove my income with my paystubs that my salary is what it is.

    My question is: Are they (attorney and ex) trying to create a precedent to have my salary reviewed every year and adjust accordingly? Is this legal or is there a limit to the number of years that this modifications can be requested by the custodial parent?

    Also, is it legal for her to request my paystubs whenever she wishes? There's an element of control and dignity (mine) that bothers me about this.

    A child support modification request can be done as often as required by either the custodial or non-custodial parent. If the custodial parent is on public assistance there will be mandatory review period, if they aren't it's only when it's requested by either party. There is no limitation as to how many times each party can request a modification; however, if it will or will not be granted is another story entirely. If you agree to hand over your paycheck stubs annually then you must do that, but usually it's more common to ask for a copy of your federal tax return.

    The CSE automatically reviews child support orders every two years. Additional reviews may occur in the event of a significant change in circumstances, such as the loss of a job, change in custody of a child, significant raise, etc.

    CSE is not involved in my case. All agreements have been made between ex and I.

    Another question is, in addition to the paystubs, what other private financial information of mine does she have legal access to?
